GENERAL TERMS AND CONDITIONS
These General Terms and Conditions govern participation in all games offered in the escape rooms “The Experiment” and “Voodoo”, as well as the sensory experience “Déjà Vu” (hereinafter collectively referred to as the “Games”).
1. Every participant in the Games is required to read and comply with these General Terms and Conditions in the interest of everyone's safety during the Games. These Terms and Conditions are available on the Games' website, www.enigmania.bg, and at the venue where the Games take place. By visiting the website or clicking on any hyperlink on its pages, players make an electronic declaration within the meaning of the Bulgarian Electronic Document and Electronic Trust Services Act, confirming that they have read the Cookie Policy, the Privacy and Personal Data Policy, and these General Terms and Conditions, and agree to comply with them.
2. The Organisers reserve the right to amend these General Terms and Conditions unilaterally, either for all Games or for any individual Game. Participants shall be notified of such changes through the Games' website, www.enigmania.bg, and by displaying the updated Terms and Conditions in a prominent location at the venue.
3. Due to the difficulty level of the Games, participation is permitted only for persons aged 9 or over. Children aged 9 to 14 may participate only when accompanied by a game operator and/or an adult aged 18 or over. Participants aged 14 to 17 who wish to take part in the Games after 22:00 must be accompanied by a parent, legal guardian or another person responsible for their care. If a parent, guardian or other responsible person is unable to accompany the child, they must arrange for an adult with full legal capacity to accompany the child after 22:00.
4. The Games take place only in the designated areas or rooms and must be played in accordance with the rules for participants established in these General Terms and Conditions.
5. The Games may be held every day of the week between 10:00 and 22:00, subject to advance booking. Reservations may be made for any available time slot shown in the booking schedules for the respective Games.
6. Participation in the Games is subject to a fee, which varies depending on the specific Game. Prices are published on the ENIGMANIA website, www.enigmania.bg, and are also available at the venues where the Games take place.
7. Participation in the Games requires an advance reservation, which may be made through the booking system on the Games' website or by calling 0888 207 885. Online reservations may be made no later than 24 hours before the scheduled start of the Game. After this deadline, reservations may only be made by telephone.
8. To make a reservation, participants must submit a booking request containing accurate, complete and up-to-date information, including their name or team name, telephone number and email address. If the information provided is inaccurate, incomplete or outdated, the participant shall be responsible for any resulting consequences, including the possibility that the booking cannot be completed successfully or that the participant cannot be properly identified and matched to the relevant reservation upon arrival at the scheduled time. In such cases, the Organiser may refuse entry to the Room and participation in the Game. The Organiser shall not be held liable and shall not be required to refund any booking deposit, the full participation fee or provide any other compensation.
9. Participants may, but are not required to, make an advance payment no later than 72 hours before the start of the Game. This may be either a booking deposit or the full participation fee, as specified in the pricing information below the booking schedule on www.enigmania.bg. Payment may be made using any of the legally permitted payment methods offered.
10. Advance payment of a booking deposit or the full participation fee may be made by bank transfer or in cash at the venue. Payment of the full amount after the Game may only be made in cash at the venue.
11. If a group of participants is unable to attend a scheduled Game due to objective circumstances, the reservation must be cancelled no later than 48 hours before the agreed start time. Otherwise, the participants in the group shall be liable for a cancellation penalty of BGN 40.
Rescheduling a Game to another date and time is permitted up to 24 hours before its scheduled start, subject to the availability of alternative time slots selected by the participants.
Reservations made using a voucher less than 48 hours before the scheduled start of the Game cannot be cancelled or rescheduled.
If participants arrive late, their available playing time will be reduced accordingly.
If participants fail to attend a scheduled Game, any amounts paid in advance will be forfeited.
If participants cancel a Game booked with a voucher without a valid reason, or fail to attend a Game booked with a voucher, the voucher shall be deemed redeemed and the Game shall be considered completed. A written record shall be prepared to document this.
12. Participants must arrive at the designated Game venue at the exact time specified in their reservation. Upon arrival, they must provide appropriate proof of any advance payment made, including a payment receipt or voucher, where applicable.
13. Participation in the Games is prohibited unless every participant has provided written consent to these General Terms and Conditions before the Game begins. Such consent must be given through one of the approved methods: via the Games' website and/or by completing a declaration at the venue.
14. The Organiser shall not be held liable for incidents occurring during the Games where such incidents result from a participant's conduct or negligence, including incidents involving the misuse of substances and/or objects carried by a participant or brought into the premises.
15. The Organiser reserves the right to refuse entry to the Game area to any person who is required to be accompanied but has no accompanying person, or whose accompanying person does not meet the requirements established in these General Terms and Conditions. This applies regardless of whether a reservation has been made or the full participation fee has been paid.
Where entry to the Rooms is refused on these grounds, the Organiser shall not be required to refund any booking deposit or participation fee, or to provide any compensation to the persons denied entry.
16. All participants must comply with the applicable hygiene and infection prevention measures during the Games. During an epidemic situation, these measures include hand disinfection upon entry, washing hands with soap and water, and wearing face masks and disposable shoe covers. Gloves are also available for participants who wish to use them.
Participants displaying visible symptoms of infectious diseases, including fever, coughing, a runny nose or similar symptoms, will not be admitted. Persons who are visibly intoxicated, under the influence of drugs or other intoxicating substances, or who display aggressive behaviour will also be refused entry.
In any of these circumstances, the Organiser reserves the right to refuse a participant access to the Game premises. The Organiser shall not be liable for any compensation other than the refund of any amount prepaid by the participant for the reserved Game.
The Organiser shall disinfect all surfaces accessible to participants after every Game using a certified disinfectant, ensure that the premises are ventilated, and provide air purification using a certified air purifier designed to remove fine particulate matter, bacteria, viruses and allergens.
17. Bringing or using weapons, ammunition, explosives, pyrotechnic devices, incendiary materials, other hazardous items, narcotic or intoxicating substances, or any other prohibited substances or materials that may endanger the health or safety of visitors is strictly prohibited.
Animals are not permitted in the Games.
Food and drinks are not permitted, with the exception of commercially bottled mineral water.
For the purposes of these General Terms and Conditions, the prohibition on bringing such items or substances into the Games also applies to their use, regardless of whether the Game takes place indoors or outdoors.
18. The Organiser or building security personnel may request and inspect a participant's identification documents and personal belongings upon entering or leaving the Room if there is reason to suspect that the participant has violated the law or these General Terms and Conditions, or has assisted in such a violation.
The Organiser may also check a participant's identification document to verify the identity of the person who made the reservation, prevent unauthorised use of a paid booking, or confirm the participant's age.
19. Every person participates in the Games at their own responsibility and risk. Participants are also responsible for their personal belongings and luggage. The Organiser shall not be held liable for any personal belongings or luggage that are lost, stolen or damaged during the Games.
20. Participation in the Games is not recommended for individuals with medical conditions that may be triggered or aggravated by confined, dark or enclosed spaces; unusually bright or dim lighting; sudden or flashing lights or sounds; particular types of noise; or similar environmental factors.
This includes individuals with asthma, claustrophobia, epilepsy, heart conditions or acute infectious diseases, as well as pregnant individuals. Anyone with such conditions who chooses to participate does so entirely at their own risk.
21. If a participant’s health condition or other important circumstances make it necessary, the Game may be interrupted immediately at any time. If the participant is in an enclosed room, they must leave the room, accompanied by other participants if necessary. In such cases, provided the Game is not terminated, the remaining participants may continue playing.
22. In the event of force majeure circumstances (such as natural disasters, accidents, severe weather conditions, strikes, martial law or civil unrest, legislative changes or acts of public authorities, power outages or other similar events), the Games shall be suspended until such circumstances cease to exist.
In these cases, the Games may be rescheduled, cancelled or resumed immediately, depending on the circumstances. The Organiser shall remain entitled to receive the agreed payment for the Games and shall not be required to refund any amounts paid by participants.
In the event of a technical problem during a Game (including the malfunction of one or more puzzles, delayed or incorrect activation of game elements or software, internet connectivity issues or similar problems), the Game shall be interrupted and participants must leave the premises.
Once the problem has been resolved, the Game may be rescheduled, cancelled or resumed immediately, according to the participants’ wishes. In all three cases, participants shall not be required to make any payment to the Organiser.
23. The Organiser reserves the right to terminate a Game at any time if any participant refuses to comply with the safety rules, the rules of the Game or the Organiser’s instructions. In such cases, the Organiser shall not be required to refund any participation fees paid.
24. The maximum duration of a Game session is 80 (eighty) minutes. Each session may accommodate a minimum of two and a maximum of six participants. Participants are not entitled to request an extension of the playing time. Late arrival may result in reduced playing time, and participants shall not be entitled to claim a reduction in the advertised price of the Game.
25. The Games are subject to continuous video surveillance. By entering areas under video surveillance, participants are deemed to have been informed of and to have consented to such surveillance. Video surveillance is carried out both because of the nature and principles of the Games and to ensure the security and safety of participants.
Participants also agree that video and audio recordings made during the Games may be stored and processed by the Organiser and used by the company for statistical and marketing purposes, without limitation as to time, territory, medium, method or means of use.
Participants who do not agree to such use may express their objection in writing by submitting a specific declaration at the venue.
26. Without prejudice to the mandatory provisions of applicable law, the Organiser’s liability for damages arising from or relating to the services provided by the company, including damages caused by the company during or in connection with the organisation and conduct of the Games in the Rooms, shall be limited to cases of intentional misconduct or gross negligence.
In financial terms, such liability shall be limited to the amount paid by participants for the relevant services (for example, the Room booking fee or the participation fee for the Game).
27. The Organiser shall not bear any personal or financial liability for damages suffered by participants as a result of improper use of the Games or their puzzles, or failure to comply with these General Terms and Conditions.
28. Every participant must respect the integrity of the Games and must not break, damage, remove or otherwise interfere with any Game elements.
For the purposes of these General Terms and Conditions, “Game elements” include all parts of the interior and exterior, puzzles and riddles, and any other belongings, materials, objects, mechanisms, devices, equipment and furnishings located within the Game area.
29. The Organiser reserves the right to pursue financial and other claims against participants who violate these General Terms and Conditions.
The Organiser also reserves the right to pursue financial and other claims for any damages, including actual losses and lost profits, resulting from improper use of Game elements or from Game elements being broken, damaged, lost or stolen.
Participants who cause such damage, or directly or indirectly contribute to its occurrence, shall be liable to compensate the Organiser.
Participants acknowledge and agree that the Organiser’s losses may include not only the cost of repairing or replacing broken, damaged, stolen or missing Game elements, but also losses resulting from the suspension of a Game for an indefinite period, the inability to accept reservations, cancelled reservations or Games for subsequent participants, compensation paid in connection with such cancellations, and other similar consequences.
30. Smoking, audio recording and photography or video recording of any kind, using any type of recording device, are strictly prohibited in the rooms where the Games take place and in all ancillary areas.
31. All information relating to the Games constitutes a trade secret and must not be disclosed in any manner.
32. Copying, distributing, publicly displaying or creating other games that may be considered derivative works of the Games is prohibited. The Organiser reserves all rights to take legal action against any person who infringes its intellectual property rights.
33. Every participant undertakes not to disclose to third parties any information concerning the storylines or puzzles of the Games, including, but not limited to, information about their appearance, design, models, components, elements, materials used, operating principles of mechanisms, the sequence in which puzzles are solved, or any other information relating to objects, materials, mechanisms, devices and equipment used in the Games.
34. Game Vouchers: The Organisers offer the option to purchase game vouchers, which require advance payment of the full Game price for the relevant number of players.
Vouchers may be ordered by telephone and subsequently purchased at the venue or delivered by courier or email.
Vouchers are valid only for the period specified on them. Each voucher contains a unique code and may be redeemed only once.
The Organisers shall not refund any difference in value where a voucher is used to pay for a service costing less than the amount originally paid.
Vouchers cannot be exchanged for their equivalent cash value.
Vouchers are valid for six months from the date of issue indicated on them.
A voucher shall be deemed redeemed, and its value shall not be refunded, if the person using it to book a service:
- Fails to attend at the agreed time;
- Arrives more than 30 minutes late;
- Cancels the reservation without circumstances beyond their control less than 48 hours before the scheduled service;
- Requests to reschedule a reservation more than once under the established rescheduling procedure.
35. The Organiser collects, processes, uses and stores personal data provided by participants solely for purposes related to the Games and in accordance with the Bulgarian Personal Data Protection Act.
The company is registered as a personal data controller in accordance with the provisions of that Act.
The company shall not disclose participants’ personal data to third parties.
36. The Organiser reserves the right to send participants electronic communications relating to Game reservations, as well as messages concerning the services provided by the Organiser, promotions, changes to terms and conditions, surveys and other similar matters.
By accepting these General Terms and Conditions, participants agree to receive commercial communications from the Organiser.
Participants who do not wish to receive commercial communications must send an explicit request by email to the Organiser’s contact address.
